Legal Question in Family Law in Virginia
Out of State Visitation
My husband and I need to know if now that we have moved 25 miles away from the mother of his son and intyo another state whether or not we can take him to our home during our court ordered visitation. Loudoun County domestic courts and Social Services are involved in this. We have filed for partial custody of the child since the mother has complete legal and physical custody.

Re: Out of State Visitation
Unless the court has placed a restriction on your husband's visitation, ordering that he not take the child out of state during visitation, there should be no problem. If there is such a restriction, your move might be a reasonable basis to return to court to ask for a change which would permit visitation in your home. You haven't explained what the involvement of Social Services in this matter is, and that could make a difference regarding what the court would permit in the way of changes in a visitation order.
