Legal Question in Family Law in Virginia

Out Of State Visitation

Does Virginia allow out of state visitation? I currently live out of state about 7 hours away from my son. I come and visit him when I am scheduled to with in the state of Virginia which is once to twice a month. The current schedule runs out the end of the school year and a new one will need to be written. I would like to have my son with me for a few weeks in the summer. I do not know if his mother would agree to it. There is no justification to her not agreeing. She tries to keep him away from me as it is. Sometimes coming up with excuses as to why I am unable to see him now. When I tell her if she does not allow the visit I will file contempt then she goes along with it. So I am wondering do Virginia judges allow out of state visitation, especially if it is for the summer. Or do they only allow visitation to take place in the state. My son will not need to be on a plane and I would be the one providing transportation. Picking him up and bringing him back. Also he is 6 years old, I am unsure if age plays a factor or not.

Re: Out Of State Visitation

No, there are visitation orders often issued by Virginia courts which allow for out of state visitation of subject children under the appropriate conditions.
