Re: different state,divorce, children

If you're a resident if Virginia, you can file for no fault divorce any time after you've been separated from your husband the required 12 months, continuously and without cohabitation.

The issues involving custody of your children, support and visitation, as well as other issues related to the marriage can be worked out even if your husband is out of state if he's willing to cooperate with the process required to settle these matters.
