Legal Question in Family Law in Virginia

statute of limitation on paternity

I was wondering what the limitation was for determining paternity in virginia. I've always know of who he was, but when my mother tried to take him to court when I was a child he fled the state and she didn't pursue it. But he is back in VA now.I was wondering if I would be able to take him to court to derermine that he was my father. I am currently 24 years old.

Re: statute of limitation on paternity

Unfortunately adult children generally have no right to haul an individual into court to prove or disprove paternity.

The exception is when it is medically necessary. You would have to prove this to a judge before he would allow the case to proceed.

Good luck.
