my step aunt says she has custody of my son?

my question is can my step aunt have any rights to my son? she says she has joint custody of my son because in the state of va. if you leave your child in there custody for over 3 months they can get it which i didnt and i havent been to court can she already?

I know of no such law regarding the custody of children in the Commonwealth.
