step daughters last name

I am to be married in two months, my wife to be's daughter carries her maiden name. do we need fathers permission to change last when we are married?, father somewhat in picture but not regular.

The name change for a minor is done through your local circuit court. The father of the child must be given notice of the proposed change and, if he chooses, can come for a hearing to oppose it.

Like almost any other issue involving children, the court will decide the issue based upon what it believes to be in the best interests of the child.

A petition for a name change would need to be filed. A court will consider the name change request based upon what is in the best interest of the child. Keep in mind that if a name change is approved so that the child uses your last name this would not affect custody, visitation, etc. since such will only be affected if the child is adopted.
