Can a step parent legally cover step children on their health insurance if their spouse(biological parent) does not have custody?

While I am not aware of a provision barring this in the statutes or insurance policies, it does not seem like a very good idea absent a good reason and a written agreement about it. You might also check with the health insurance carriers about it.
