step parents rights

thank you for the information. my next question is do i have any rights to my step son in this state(virginia)? my husband has sole custody and i have been in his (step-son) life since he was 18 months old, he will be turning 10 in july. My step son wants me to adopt him does he have any say in the matter? His birth mother has no legal visitation with him and only sees him just enough that i dont think we could get the adoption approved. she is willing to sign over all her rights but only if my husband drops child support and lets her have my step son over night once a month or more. is there anything we can do to stop her from tormenting this child anymore??
