step parents rights

do step parents have any legal rights in the state of VA.?i have a 10 year old step son whom i have helped raise since the age of 18months, his father has sole custody and we would like for me to adopt him, and his mother is willing to sign over her rights but with many unacceptable conditions, she doesnt have any legal visitation to him and does not pay her court ordered child support, however she makes sure she cals about once every 3 months or so, so we cant prove she doesnt have a vested interest in the child, what are the chances of a judge terminating her parental rights and do i as a very active step mother have any legal rights i this situation? if his father and i were to divorce(we are not but what if) would i have any chance at visitation with my son?

The attorney that I previously recommended that you consult with should be in a better position than anyone in this forum to address these questions after s/he has had the opportunity to consider the relevant facts in greater depth and any applicable documentary evidence which might be applicable to this situation.
