Legal Question in Family Law in Virginia

subpoena duces tecum - notice

I wanted to know if there is a form to use for a ''letter of intent'' or ''notice'' prior to issuing a subpoena duces tecum for cell phone records or phone (tangible). This would essentially inform opposing party of the coming subpoena and in theory prevent any tampering with the cell phone.

Re: subpoena duces tecum - notice

I am not aware of any such form but there would certainly be nothing to prevent you from writng one up and sending it to the defendant(if that's who would be getting the subpoena).
