Legal Question in Family Law in Virginia
can i sue my attorney
We went to court form my divorce mid September. My divorce was final the beginning of November. The judge wrote on the decree that the case would be left on the dockett for 120 days while we pursued a QUADRO. I agreed to allow the money from the QUADRO replace child support for how ever many months so that would give my ex time to get on his feet. My attorney understood that this money was my child support and I had to have it. He did not even pursue the QUADRO until mid December. In the meantime however, my ex was supposed to pay child support until I got the QUADRO check. He has not. I have called my attorney and left messages, sent emails and called today and was told by his secretary that they have received some stuff from my ex's company but that they have not mailed out anything other than the originial letter to get it moving. I also had mentioned to him several months ago that I could go on through Child Support Enforcement if it is quicker because I was running out of money. He assured me that would take to long. Well, here we are with 30 days left of the 120 days the judge allowed. My credit card is maxed and I missed my house payment this month. Isn't he responsible for this?

Re: can i sue my attorney
You have apparently been ill-advised by your counsel. (The kind of arrangement which was apparently proposed rarely works out--in my opinion.) Does this apparent ill advice give you a basis to sue this attorney for malpractice and recover damages?
No, unfortunately, I would think not.
