Suing Adoption Agency!
We used an agency in PA(we are in VA) for the adoption of our daughter(born in PA). She completed the ICPC paperwork, punitive father paperwork, and needed paperwork with the birth mother. We were told that after our home study was complete, she(adoption agency) would send their consent for the adoption(she holds custody until then), which would allow us to start finalization.
Well, now we are ready for her consent and the adoption agency has conveniently(for her) gone out of business and let her license lapse without notifying anyone! She claims that she had not heard from us in months(a lie that we can prove). So, she currently holds custody of our daughter and can't transfer custody b/c she has allowed her license to lapse.
Now we are unable to complete our adoption without significant problems. Our attorney actually doesn't know what to do. They have never experienced something like this.
My question: Are we in a position to sue her? We paid her $15,000 for the adoption and now she is not completing her end.

You need to consult and/or hire an attorney about writing a settlement demand letter for you and then filing suit if necessary. Good luck.
