Legal Question in Family Law in Virginia

Support Appeals

Can a non-custodial parent have his arrears reduce because he was incarcerated. He knowing commited a crime to which he knew would give him a long jail sentence. He had a job, a life, a choice, but he choose to commit this crime and received a 11 year jail sentence. He went to court while incarcerated to have it dropped while he was in prison, but it was denied. Now that he is released he wants to have it reduced, does he have a chance in getting it reduced?

Re: Support Appeals

While the arrearages might not be reduced, going forward payments may decrease if he successfully petitions for relief under the statute.
