Surrogate pregnancy

Does Virginia law allow a surrogacy contract between a women who resides in Virginia and 2 married men in Massachusetts? Does it make a difference that one of those men would be the father of the child throug IVF?

The short answer is that Virginia law would be very hostile to such a surrogacy contract and, if the law is followed literally, the contract could not be approved by the Court.

It would be better to look at Massachusetts law on this.

Please see a lawyer before you attempt to do this in Virginia, to avoid much pain and heartache, and potential harm to the as yet unconceived child.
