Legal Question in Family Law in Virginia
Taking Child Out of State
The mother of my child has physical legal custody, we both have legal. She has decided to move from VA to Ohio in order to get married. We have a court order giving me every other weekend from Friday at 6:00 to Monday at 5:00. I take him to school and pick up on Mondays. I have three weeks during the summer. I do not know this man she is to marry. All of my son's great grandparents and grandparents and maternal grandparents live here. The maternal grandmom watches him before and after school. What are my chances of keeping him here in Va? And if the visitation changes from the original order who is responsible for bringing him to VA, as it is 10 hours away. My son is eight. I'm devastated by this. The mother has a court date of 31 Aug., which my son will be in Ohio school at that time. I know nothing of living conditions there, although she wrote that it was for the betterment of child. How can that be not to see his dad on regular basis?

Re: Taking Child Out of State
Without a lawyer representing you at this scheduled hearing, your chances of largely prevailing in this matter are likely not very good (in my view).
