Legal Question in Family Law in Virginia

Temporary Custody Agreements for Military Single Parents

I am entering the military in 13 mos. and I have been told that I need to sign over custody of my daughter to a temporary custodian. Is this is a process that I can do on my own or will it require a lawyer? What exactly is the process for this? Thank you.

Re: Temporary Custody Agreements for Military Single Parents

I had to do this for a client a couple of years ago. Whether it's something you need a lawyer for may depend on your status. If the child's other parent is alive and hasn't given up all parental rights, you will need that parent's signature on an order granting temporary custody to another, and the order will need to be signed by a judge of the Virginia Circuit Court which gave you custody in the first place. If it was not a Virginia court, or if it was but you can't get consent from the other parent, you will have to file a motion in the Virginia court that granted the divorce or in the Juvenile and Domestic Relaitons Court in your area. You can probably get by in the J&DR court without an attorney, but in the Circuit Court you probably need an attorney.
