Legal Question in Family Law in Virginia
Temporary Legal Custody
I have cancer and would like to grant temporary legal custody to my sister and brother-in-law until I am better able to care for him. Father is not in the picture, sister lives in Virginia, I live in Arizona and will be moving to Virginia in 3 months, but the school in Virginia won't allow my son to attend if I am not living there. There is a code there stating something about a child being in legal custody of a resident if the parent is unable to care for him, but I'm not sure how to get him into her custody and I don't want anything permanent - only for 3 months.

Re: Temporary Legal Custody
Guardianship is the remedy by which this situation is normally handled in
Virginia. Your sister (with evidence of your written consent)should petition the local Juvenile & Domestic
Relations District Court (J&DRDC)for
temporary guardianship of the child for the period at issue.
