termination of maternal

My wife ( now ex) left for Austrailia in November 2001, she got sick and also got involved in a child abuse case (there) and wasn't able to return to our 2 children (ages 3 & 11months, at that time). She decided to return when the man she went to see, and commited adultry with, could also come. In January of 2003 she could have come but she waited until her, him and their child could come. She finally came home in May of 2004. My children now 4 and 6 know my new wife as Mommy, because she has been there since about 6 months after their mother left. What would be our chance to get her (my ex wife's) rights terminated? My new wife wants to adobt them.

If your current wife wishes to adopt your children, she should retain counsel to prepare and file the appropriate adoption petition.

During the course of the adoption process, the court of proper jurisdiction will decide whether

the biological mother's parental rights should be terminated and your wife's petition to adopt granted.
