Legal Question in Family Law in Virginia

If there is no such thing as a legal separation in VA. and a couple write up an agreement between them that states they are separating "emotionally" not living as husband and wife but living in the same house for financial reasons and are free to live their lives as far as "seeing" other people but they are still legally married is it adultry if they have relationships outside the marriage? There is no property settlement in this agreement , finances still stay the same.
