Tracking Adult Persons W/ Out Prior Consent

Is it illegal in the State of Virginia to track and adult person using GPS technology without their prior knowledge and/or consent. Evidence to be used in a divorce case.

As long as the "tracking" does not amount to what the Commonwealth considers "stalking", there should be no problem with this activity, from a legal perspective.
