Legal Question in Family Law in Virginia

How do I go about transferring my Virginia custody case to North Carolina. It has been in Va since being filed in 1999. I now live in NC and have been here for a year. I have physical custody with the father having visitation in the summer and holidays.

You should be able to "domesticate" your Virginia decree

or order by registering it with the appropriate court in

North Carolina.

Go to the clerk's office of the highest North Carolina trial court in the area where you currently reside and they should be able to inform you as to exactly what you need to do to conform with the requirements of that particular jurisdiction for registering your Virginia order.

You may want to start by contacting one of the case coordinators listed at:

http://www.nccourts.org/County/Moore/Courts/Family/FCStaff.asp

You will need 2 EXEMPLIFIED COPIES of the most recent Virginia Court Order.

The staff there should be able to provide you with the forms necessary to (1) register the Virginia order and (2) file a motion to modify the visitation.
