can u file custody of ur child in a nother state if u lived in virgina with the father and both parents have filed in virginia but just havent been to court yet

Should be possible if no Virginia court has as of yet
entered an order in the custody matter, but if such an order
were entered in the Commonwealth before one could be entered in an appropriate court of the other state, the latter action would then
most likely be subject to dismissal under the rules
governing the Uniform Child Custody Jurisdiction Act
to which virtually every jurisdiction in the U.S. is a signatory.
