Legal Question in Family Law in Virginia

Unfit mother

My husband has been paying child support/alimony for 11 years now. We have a 9 year old together and she is always put on the back burner so the ex can get her money first. The problem is, his ex moves constancy because of eviction, phones, cable, lights etc. are cut off and her church as well as family have bailed her out more than once. We have found out she averages $7920.00 in bad bank fees per year for simply spending money she doesn't have, mean while the kids never have clothes, school supplies, food etc. and are are simply not provided for. Makes us sick. Is this an unfit mother? She is more than compensated monthly to care for the kids and choses to spend money on DVD's, cell phones, football games etc. and not her bills. What can we do about this? Thank you

Your husband could file for custody, but I doubt

that the court with proper jurisdiction over this matter would rule in his favor on the basis of the facts which you've presented.
