Legal Question in Family Law in Virginia

unknown father but soon to be husband wants to adopt

I have a 3.5 month old daughter. There is no father on the BC. I have no idea who the father is however, my soon to be husband wants to adopt my daughter. How can he legally adopt her without a known biological father?

Re: unknown father but soon to be husband wants to adopt

Merely because there is no father listed on a child's birth certificate

doesn't, of course, necessarily mean that the biological father is truly unknown. Nevertheless, if you claim that you truly have no idea who this person is, a so-called step-parent adoption can still go forward with your husband as the adopting parent and with, perhaps, some kind of constructive notice to the allegedly unknown one regarding the pending adoption published in a local newspaper with the court's permission.
