Legal Question in Family Law in Virginia

VA/TX Custody

G/f and I lived together in Texas for over a year then we broke up. We had a child. She moved to Missouri (where she is org from) and I moved with the 10 week old child to VA (where I am originally from).

I filed for custody as soon as I got to VA.

The custody court date is in Oct but I just got served for a writ of attachment in Texas and have to report to court. The mother filed it in TX but no longer lives there. They look to give the child back to the mother. I have to appear in court next week in Texas and by that time the child will have stayed in VA for 9 weeks. There was no court oder out when I filed for custody in VA.

I haven't lived in VA for 6 months to get legal aide and since I don't live in TX anymore I can't get legal aide there. I was told I need a lawyer in both states.

Can state of TX take the child away even before VA hears the case? I can't afford 2 attorney's..how can I retain one? Should I show up with the child?

The Texas court should be informed that the matter should be dismissed since neither of the parents nor the child reside any longer in Texas.
