Legal Question in Family Law in Virginia

Violation of Divorce Decree

If our Divorce Decree states that if a party is interested in change to the custody or visitation as stated in the divorce decree that mediation will be used (and the firm is stated). ''The parties shall each exercise their best efforts to resolve the disagreement through the assistance of the mediator. In the event that they cannot reach an agreement during the mediation process'' then either party may petition the court.

My x has petitioned the court for a change in custody without even booking a meeting with the mediators.

What can be filed to stop the current proceedings and force mediation?

Re: Violation of Divorce Decree

Your lawyer could file an answer in the circuit court requesting that the motion for a change in the terms of the custody arrangement be dismissed, citing the reasons which you've mentioned.
