Legal Question in Family Law in Virginia

violationn of settment agreement

In my settlement agrmt there is an ''interferance'' clause...basically it says that each of us can lead sep lives without the inerferace of either party. Well...he has violated that by contacting my friends on their computers, myspace pages and phone by posting not so nice things about them so all can see. Since he violated that does that mean that the settlement agreement is null and I dont have to keep up with my end of the deal..such as paying the mortgage? Is that not clearly interfering in my personal life? He is causing me and my boyfriend undo stress on our relationship.

Re: violationn of settment agreement

No, it does not mean that your PSA(Property Settlemen Agreement)is now null and void due to the alleged violations of the other party nor that you are now excused from having to pay the mortgage as apparently required under the terms of this PSA.

You may wish to contact the attorney who hopefully represented you in negotiating the PSA document to determine what actions might now be appropriate as well as feasible (if any) for you to now pursue for these alleged breaches of this agreement.
