Virginia Child Support Question - Can the amount of a child support obligation be based on anything other than actual income? My current child support obligation is based on a prior income that I have not earned in nearly three years. I was unemployed for over a year due to layoff and in my current employment position earn $30,000 less than I had previously as it is the only job I could find. However, the judge refused to lower my child support obligation, refused to base it on my current, actual income because I failed to return a discovery paper to my ex's attorney by the time stated. The paper was returned only a few days late. Due to that he found me in contempt and ordered that my child support obligation continue to be based on my prior income rather than my current and actual income. The judge also ordered that I cannot file for a reduction/modification until all owed is paid in full. Is this legal? I thought child support was based on actual income?
