Legal Question in Family Law in Virginia

I Help in Virginia. (Court case in VA) My daughter is 14 years old (15 in Decemeber). She was supposed to travel to her Fathers house for 7 weeks the other day. He has not called her since March or early April 2011, He will not return her emails either. I tried to calls 3 days before she was to travel and left messages and then 3 times on the day she was to travel. No one answered, but I left messages. I did not put her on the plane. I feared no one would be there to get her. At this point I am not even sure he is around.The last we spoke I asked him to contact me via phone. He was arguing with me over emails and I had enough of it. We have not had any voice/phone contact with him since march/April 2011. I am not sure what is going on. He still has not called asking about her, if or when she is coming. I am not even sure if he is sending the emails or his wife is. The email is in her name not his. I will say that this all started because my daughter asked to come less time in the summer. He at first said he would consider it and them lashed out at her and called her a spoiled brat and told her she should be happy that his wife (Her step Mother) is a teacher and can spend the summer with her. he also said in the email that he would "Deal with her" when she gets there. She has been worried about that. She was scared. He has never taken any vacation time form work to spend with her. He did not not even take her for Spring break in March because he or his wife would not be off work to spend time with her. She asked for a reduction in time so she could attend some camps and spend some time with her friends too. He has 7 weeks ans she asked to reduce to 4. Thanks.

There are a lot of issues here that it will be difficult to address without a good deal more information. The first question that I would want to ask is how long you and your daughter have been in NC. If you have lived there for more than 6 months, you may be able to move the custody and visitation case there. If not, you may want to contact your VA attorney to file something in the VA court. There is a potential here that you will be facing a show cause for failure to comply with a court order. I am sure that economics is an issue; it is for all of us. But you should consider at least an initial consultation with an experienced family law attorney to give you some concrete guidance. You should bring copies of all court orders when you visit.
