Legal Question in Family Law in Virginia

Not using visitation

My ex has custody I have chosen not to see the kids for over 2 years because of alot of problems with my ex. Now she is taking me to court for not taking them, can she do that and if so what could happen also if I were to voluntarily terminate my rights to the children would I still have to pay child support?

Re: Not using visitation

Without reviewing the relevant divorce decree or other court order, there's no way to determine whether she has a valid basis to assert that you are now in contempt of the order.

A parent who has had his/her parental rights terminated with respect to a certain child or children is no longer obligated to pay child support for that child or children. (I would, however, urge great caution before you undertake

this irreparable remedy.)
