Legal Question in Family Law in Virginia

visitation enforcement

I have physical custody of my son and the father currently has liberal and frequent visitation as negotiated by the parents. He picked up my son from daycare 48 hours ago and continues to refuse to return him home from me. What can I do to get my son home? Do I have to wait until our court date (which is 2 months away) for a set vistiation schedule? There has got to be something I can do as the cusdodial parent when the non-custodial parent is withholding the child.

Re: visitation enforcement

Yes, you can go immediately to the court which currently has jurisdiction over the custody issues and request an emergency hearing on the matter.
