Legal Question in Family Law in Virginia

visitation

I'am the father of two dauthters ages 7 and 4 both of whom reside with there mother. I do not have joint custody. My

current visitation is every other weekend from 6pm friday

until 6pm sunday including out of state and every wednsday

from 5pm until 8pm. My childrens mother has recently told me she is planning to move to Richmond VA. for empolyment purposes. Given that I do not have joint custody can she legally move away to another state, and if so how might this affect my child support and visitation?

Thank you for your inquiry.

If you, as the noncustodial parent, have been regularly visiting with the children (i.e., parenting time), she cannot unilaterally remove the children from the state of New Jersey without a Court Order.

You should consult with your New Jersey attorney who represented you in the matter which resulted in the visitation order which you have described. If this person is no longer available, then you should seek out the appropriate family law practitioner for advice who is familiar with the court which entered this order and which continues to have authority over the matter.
