Legal Question in Family Law in Virginia

Visitation- moving to a different state

I am the sole custodial parent of my daughter. My visitation agreement allows the father visits every Wednesday, every other weekend, alternating holidays and 2 weeks in the summer. We both currently live in Maryland but I will be relocating to Richmond, VA. It will now be a 3 hour drive between both homes. What type of modifications can I make regarding the visitation agreement I currently have in place? Will I have to continue the every other weekend arrangement or are there exceptions since the distance is now greater than 100 miles?

Unless you have a separation agreement which discusses this issue, you'll have to work out a slightly different arrangement with the father. It seems to me that you'll still be close enough to keep the present schedule in place except for the midweek visit. Maybe you'll give him a little extra time elsewhere to compensate for that if he wants it. On the weekends, if he doesn't want to drive to Richmond twice each weekend, maybe you'll agree to split the transportation--you deliver your daughter to him and he brings her back, or vice versa. A common sense approach by two caring parents who are able to communicate with each other in a civil manner goes a long way toward solving these kinds of problems.
