Visitation Question
My husband asked me to leave a couple of weeks ago. He said he did not want to be married to me any longer. I left with my daughter who is 6 months old. My question is, what visitation rights does he have? I am currently in the process of working this all out with my lawyer, who is out of town. My husbaband is pressing me now to see her whenever he wants whenever he feels like it.
Can I restrict his vists to a couple of days every two weeks? Can I require he define the days he will see her ahead of time and not let him see her at his will?
Can I prohibit her visits to his place until he has a proper crib and supplies for her.
He is also smoking again and I don't want he or his friends smoking aroung her.
He is not currenly paying any child suppot. I wasn't sure if this had any baring on the issue.

In the absence of a court order, you yourself have no specific legal right as one of the
natural parents(and natural guardian)of the child to impose any specific limitations or constraints on the rights of the other natural parent with respect to your child until these limitations or constraints are realized in the form of a court order.
Until that occurs, the arrangements and conditions regarding the issues which you've mentioned must be voluntary and by the consent of the parties.
