Vistation for aunts/uncles and 17 year old childs rights to leave his custodial
My nephew is 17 years old. He will turn 18 in 4 months. He currently does not want to live with his custodial and biological father. He has requested to live with his paternal grandparents. His current home life has not been the best and has frustrated family members that want to help but do not know the law. My brother has threatened to keep his son from seeing any of us if we try to intervene. I, for one, do not want to see the boy suffer any more. Does my nephew have any recourse other than emancipation? Can he choose to live with his grandparents or other family member against his father's wishes? His biological mother is currently not capable of raising him at this time (due to living conditions) but may be willing to support him living with another relative other than the father. Also, in the state of VA, can my brother keep me from seeing my nephews? Please inform me if I need to take legal action so that I can pursue this immediately before futher damage occurs. Thank you

I can't imagine what kind of legal action you have in mind. In a mere four months this young man will legally have the status of an adult and can live wherever and with whomever he chooses.
