i wanna keep custody

i have had custody of my two girls for 4 1/2 years now.in feb. i was stopped for 1st time dui, with a .08 bac,my girls were in the car with me.the mother found out and now wants custody. the mom lives in florida and has only seen the girls 12 times in 4.5 years,she does not call or send card/gift on thier birthdays or xmas and her family has nothing to do with the girls.they are honor roll students and have close relationship with my family alsowe we first went to for custody the judge gave her the choice move back to va. and have custody or stay in fla. and lose custody, she chose fla.i paid my fine and want to know if the judge will take into consideration how i have raised the girls since i have had them or will he take them away from me bace on one bad decision...thank you

Yes, in determining what's in your girls' best interests, the judge will always take into consideration as to how you've raised them.

However, he or she will also take particular note of the fact that while you were dui, you had the girls with you in the vehicle.
