Legal Question in Family Law in Virginia

I am wanting to move out of state when my children get out of school this year to North Carolina. My ex whom i have my children with is getting ready to go to jail for a year. Do you think that i would be awarded sole custody and granted to move?

Unless there's currently a custody order in effect and/or

other order which requires you to give at least 30 days advance notice

to the father as well as the court of any such move, then you

could move any time without petitioning the court for sole custody or permission to make such a move.
