Legal Question in Family Law in Virginia

My wife abandoned my oldest son and I 3 Christmas ago, she sent my oldest son and myself to South Dakota to visit family, while we were gone we got an email saying we need not come back. we had been together for 8 years. My youngest son Austin is still living with her, she is going to school and working full time and Austin is often being babysat, one of the sitters she uses is her father whom is a convicted sex offender found guilty of taking advantage of his own daughters, this situation is unacceptable to me. What are my chances of gaining custody of him, I believe he and his older brother should be raised together. Is there anything I can do.

You could sue for custody of Austin in the local J&DR;Court in the Virginia city or county where he currently resides.(I would not, however, be so presumptuous as to attempt to predict your chances of success.)
