Legal Question in Family Law in Virginia

My wife and I are seperated, over a year now, and we gave custody of or 12 year old son to my mother when he was 2 years old. My wife has not contacted him since she left us a year ago. My Mom is about to have a very serious life threatening surgery on her neck. What can i do or have put in place that relinqueshes custody back to me if something would happen to her. I have been in his life as a dad the whole time but never got custody changed back because my Mom took care of him most of the time while we worked. My son wants nothing to do with his mom.

File a petition for custody of the boy with the J&DR;court in the

locality where the boy resides.

The clerk's office will have the necessary forms there for you

to complete and sign in order to file this petition.
