Legal Question in Family Law in Virginia
My wife and I are seperating and we have a home that is paid for in NC
where the marriage took place in 2000 however we have lived together
for 11 years and have 3 children. She took out a fictious DOV in NC
and had me thrown out of my home, where I have lived for 9 years, and I
was forced to move to VA where my family is located to survive. She
wants cutody of the kids and the house in a consent judgement. And she
wants child support. I feel like I am getting screwed... is there any
thing my attorney can do, it seems like he is working for her? I have
supported my family for years, and I have an order from a previous
marriage for $279 for a son I adopted. I am tired of getting the short
straw. Will she get the house if I do not sign the consent. We go
back to court Aug 26 and the attorneys are working out a consent, but
the DOV has been continued twice now. What should I do and can I seek
monetary judgement for this? I have been laid off since Nov 2008 and
was proactive in changing careers so I could find work. I took and
passed a Phlebotomy course in NC and now I work part time in VA but I
barely make it on $9.00 per hour I get around 50 hrs every two wks. She paid off this home with money she recieved from her mother, from a law suit where her brother was killed. This happened five years ago, but like I said up until Nov 2008 I have always worked and paid whatever needed paid she did not start working until our youngest daughter was in school. I have to drive for 3.5 hrs to pick my kids up and take them back 2 days latter which is killing me financially and is totally unfair. Can you advise?

If your North Carolina attorney seems to be "working for her" and dabbling with consent judgments with which you do not approve, then, perhaps, you should hire another attorney.
