My and my wife are voluntarily separated, but no papers have been filed. Is it legal for her boyfriend to spend the night while our son is there?

Va. Code Sec.18.2-344 classifies fornication as a Class 4 misdemeanor offense and clearly illegal (whether children are in the venue where it occurs or not).
