Legal Question in Family Law in Virginia
My wife has a 4 year old son who she shares 50/50 custody with an out of state father. The case is being handled in the other state by a judge who seems at times to be unreasonable. My wife has been a VA resident for about 3 years now. How possible would it be to get the venue changed to VA and what would it take?

Under the Uniform Child Custody Jurisdiction Act (UCCJA), the answer would appear to depend upon where the child actually resides for the majority of the year, and if it is almost precisely split, then the current court would likely retain jurisdiction(inmy opinion).
