Legal Question in Family Law in Virginia
I will be filing for divorce with the help of a paralegal, I can not afford an attorney and my husband regused to sign the separation agreement once mediation was complete. We have a minor child together, he refuses any type of contact so he hasnt seen the our son in in 8 mths. The mediation agreement has custody and child support written out as well as my husband paying for half of our sons private school tuition. Me husband will drag everything out as long as possible, he has promised me this. Can I file for child support without filing for custody ? should I file for both at the same time ? He told me he will file for custody if I file...but I have several emails proving that I allowed him visitation but he said it was to difficult. I also have an email from him demanding that I have no communication with him..also making shared custody a bit difficult. Like I said, there is not way I can afford an attorney.

File for both child support and custody immediately in your local J&DR;Court and do not be deterred from being proactive in your case by your husband's continued dithering and unenforceable demands.
