Legal Question in Family Law in Virginia

What will happen

I have a 2 year old baby with a woman that lives with me. The mother and Baby have been living with me sents the baby was 4 months old. Things are not working out with me and the mother. I would like for her to move out. I want the child to stay with me. What are my right in having her move out and what are my right in having the child staying with me.

Irrespective of whether or not you're the biological father of the child, unless you can prove that the mother is unfit to parent the child(difficult), your chances of getting sole physical and legal custody of the child are virtually nil.

I am not sure I have enough information to answer your question. Are you the biological father? If so, yes you can file for custody with your local juvenile and domestic relations court. If you are not the biological father, I doubt you have any right to request custody of the child.
