Legal Question in Family Law in Virginia

Will A Judge Consider This?

Will my ex having numerous tickets help me in anyway when we go to court for a modification of custody and visitation. While I know that sometimes to judges speeding is not a huge deal I feel that my ex puts my children in danger. I can not prove that she has had them in the car with her when she has been caught speeding but most recently she was found guilty for a child restraint violation as well as passing a school bus. She received both tickets at the same time. She has also received tickets for improper driving as well as disregarding a highway sign. (From 2005 until present she has a total of 7 tickets. And all together a total of 12, she has had her license for approximately 9 years) Of course I am basing my case on other factors as well but do you think a judge will take these things into account.

Re: Will A Judge Consider This?

You have the right idea about factors. This is one factor that a judge would at least consider. I would not anticipate that this would result in a disproportionate decision in your favor standing alone, however, it would help. It could be possible to get something specific into the order about the child safety seat. Hope this helps.
