Legal Question in Family Law in Virginia

What will the judge think of this?

Hello,

My ex wife is taking me to court for an increse in CS. I know she is making more money than she says she is, we are ''supioing'' bank records to porve it. We also found out she is in huge debt with 25+ bounced checks per month every month at her bank(you can imagine the fees)and has many warrents in debt out for her. She is a very irresponsible person and her bank account stays overdrawn. How do you think a judge will respond to my ex wife and her spending lifestyle? She also recently got evicted and moved into a hotel with the kids. Thank you.

Re: What will the judge think of this?

The judge wil most likely adhere to the Virginia Child Support Guidelines which utilize the income

shares formula (total joint gross income of both parents)in determining what your share of the child support will be as well as that of your former wife.

Your former wife's spendthrift lifestyle is not a factor which the guidelines consider in doing the calculations for child support.
