if a woman in Calif says a man is the father of a child (alleged father in Virginia) 9 years after the childs birth, and he does the right thing and pays child support with-out proof of paternity, can the (father) ask for proof of paternity. the state had once sent a refund to father saying mother was unfit and awarded custody to the mothers side, grandmother .

Yes, the alleged father can file a petition in the local Juvenile & Domestic

Relations District Court under Va. Code Sec. 20-48.10 to request a paternity

test be ordered and his rights as well as responsibilities adjudicated by

that court based upon the results. (The foregoing presumes that the

caretaker of the child would cooperate in arranging to have submitted a sample

of the child's DNA. However, if there is already an order for support in California,

then everything would have to be done through the judicial forums of that state.)
