Legal Question in Family Law in Virginia

i was wondering when a non costodial parent could file abandonment charges on the costodial parent. I have a friend whose ex leaves their daughter in his custody for a week or 2 after his scheduled vistation. SHe does this when she doesnt want to deal with her. THen when she wants to play mommy again she comes back and if he doesnt give child back she calls the police. This needs to be settled so the child isnt in limbo anymore.

Abandonment on these facts? Not a chance (in my opinion).

If you friend is truly perturbed about this situation, let him bring the

mother back into court on a Rule to Show Cause (if she's supposedly in violation of the court's order).
