Legal Question in Family Law in Virginia
working parent
The day after child support was set my ex wife quit her job and has not worked in over 3 years. I was laid off and the new job I have does not have ot. I go in front of the judge next month to reasses the child support. How does that work since she is not working? Do they have an amount that she would be considered able to make or does she have the option not to work? The kids are 9 and 11?

Re: working parent
It's up to the court to decide whether, given your ex wife's particular circumstances, it's reasonable for her to stay at home full time to care for the children (given their ages, it could be)or whether she's become inappropriately unemployed and, perhaps, therefore should have income imputed to her side of the child support equation in determining the respective shares of the total child support obligation which should be apportioned to each parent.
