Legal Question in Family Law in Virginia
Wrong Lawyer for my Case!!
iam a single mother of twin girls and im going through a custody dispute with their father who has been in and out of their life for the last 3 years. now i have been given a court appointed lawyer for my custody case, and its been 9 weeks and i haven't heard a single peep from my lawyer nor has she bought me in the office to discuss my concerns for the case. and whenever i call her she brushes me off or rushes me through my telephone conversation. and just recently the courts order the father visitaion to see the girls because he didnt wanna see them.(but wants full physical custody)so when i called her and told them that the courts ordered him visitation and he was to adhere to the visitaion or visits with the girls will be terminated,
my lawyer told me well thats being a bit harsh on him dont you think?? or when i call and tell her about my case she tells me well.. ok so whats the bottom line as if she is to busy to talk. i dont want someone representing me who is concerned with the opposing party or who brushes me off and whom is rude to me? i spoke to a supervisor and she just made excuses for her because they have been friends for 30 years, but where does that leave me? is it possibe for me to change my attorney???

Re: Wrong Lawyer for my Case!!
unfortunately when you ask the court to appoint you a lawyer, you are stuck with whoever you are given unless they fall below minimum standards - and I have to tell you minimum standards are pretty minimal.
My suggestion is to make multiple appointments to sit down with the attorney forcing her to deal with you. Take a witness with you in case it comes down to word vs. word. if the lawyer will not see you then you need to write a letter to the Judge supported by evidence of the lawyer's substandard representation. To get an idea what minimum standards are, I would call or visit the website of the Va State Bar.
Good Luck
